Federal Crimes

  • Child Pornography:
  • It is forbidden to knowingly, attempt or conspiracy to knowingly, or knowingly produce, distribute, receive or possess with the intent to distribute, a visual depiction of any kind, including a drawing, cartoon, sculpture or painting that depicts a minor engaging in sexually explicit conduct and is obscene, or depicts an image that is or appears to be a minor engaging in graphic beastiality, sadistic or masochistic abuse; and sexual intercourse, including genital-, oral-, anal- genital, or oral-anal, whether between persons of same or opposite sex.


    It is forbidden for any person to employ, use, persuade, induce, entice, or coerce any minor to engage or assist any other person to engage in, or to transport any minor in interstate or foreign commerce with the intent that the minor engaged in any sexually explicit conduct. It is forbidden for any parent, legal guardian or person having custody or control of a minor to knowingly permit such minor to engage or assist any other person to engage in sexually explicit conduct.


    It is forbidden for any person to knowingly transport or ship in interstate or foreign commerce by any means, if intending to sexually exploit the child.


    Child pornography is defined as any visual depiction, including any photograph, film, video, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct, where

    1. the production of such visual depiction involves the use of a minor engaging in sexually explicit conduct;
    2. such visual depiction is a digital image, computer image, or computer-generated image that is, or is indistinguishable from, that of a minor engaging in sexually explicit conduct; or
    3. such visual depiction has been created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct.

  • Drug Trafficking:

    Drug trafficking is the sale, delivery, possession and/or manufacturing certain drugs over a specified quantity. Minimum mandatory drug offenses can range from 5 years to life in prison, depending on the type of drug and the quantity that either was trafficked or was being ready for trafficking.

  • Health Care Fraud:

    Targeting both private and public health insurance plans, these schemes include:

    • Fradulent cost reporting by institutional providers.
    • Double billing for services provided.
    • Billing for services not medically necessary.
    • Billing for services not rendered.
    • Unbundling (billing separately for groups of lab tests performed together to get more reimbursement.
    • Upcoding (billing for a more highly imbursed service than one provided)
    • Kickback (putting profit over patient's health and well-being)

  • Immigration Fraud:

    U.S. immigration law provides specific procedures through which a foreign person may legally enter and remain/be present in the United States. Ideally, entry is made with visas or other immigration documents which grant specific permission for the person to enter the United States and remain for a certain amount of time and purpose.


    If a person enters or remains in the United States unlawfully she may face removal proceedings.Examples include:

  • Mortgage Fraud:

    There are two types of mortgage fraud: fraud for property/housing and fraud for profit.


    1. Fraud for Property: The borrower usually is the perpetrator on a single lown. The borrower makes a few misrepresentations, usually regarding income, personal debt, and propertly value, or there are down payment problems. The borrower wants the property and intends to repay the loan.
    2. Fraud for Profit: generally, multiple gross misrepresentations of loan transactions with several financial institutions involved. These representations are: income, assets, collateral, length of employment is overstated; or fictitious employment is reported, sometimes backed by co-conspirators. Often the credit history is altered so the debts are not fully disclosed. Appraisals almost always list the property as owner-occupied, and down payments do not exist or are borrowed and then disguised with a fraudulent gift letter. The faulty appraisal is then inflated to increase the sales value to make up for no down payment, and to generate cash proceeds in fraud for profit.

    Mortgage fraud cases are investigated by both state and federal law officials.
